Magic Mirror Terms of Service

Effective date: October 15, 2026

These Terms of Service ("Terms") are an agreement between you and Project Magic Mirror, Inc. ("Magic Mirror," "we," "us"). They govern your use of the Magic Mirror mobile app, our website at projectmagicmirror.com, and the SkinCheck Expert Portal (together, the "Services").

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Arbitration notice. Section 9 requires that most disputes between you and Magic Mirror be resolved by individual binding arbitration, not in court. You waive your right to a jury trial and to take part in a class action. You may opt out of arbitration as described in Section 9.

1. Eligibility and accounts

Eligibility. You must be at least 18 years old and located in the United States to use the Services. By using the Services, you represent that you meet these requirements.

Access. We may limit access to the Services, for example during a beta period, by invitation or through a waiting list. We may grant, limit or end access at our discretion.

Your account. You must provide accurate information and keep it current. You are responsible for activity under your account and for keeping your login credentials secure. Notify us promptly at compliance@projectmagicmirror.com if you suspect unauthorized use. You may not share your account or create an account for someone else.

Expert accounts. Estheticians and dermatologists who register on the SkinCheck Expert Portal ("Experts") may be subject to additional terms that we provide to them. If those terms conflict with these Terms, those terms govern the Expert's use of the SkinCheck Expert Portal.

2. The Services

What the Services do. The Services analyze visible features of your skin in face photos you take and generate results that describe its appearance ("scan results"). They let you track your scan results over time, record your skincare Routine, compare product ingredients with ingredients that dermatologists generally recommend for particular skin concerns, record whether products worked for you, ask questions of Amber, our AI assistant, and share reports with Experts.

Your consent. By accepting these Terms, you consent to Magic Mirror and its service providers collecting and analyzing your face photos, and processing the health-related information you provide, as described in our Privacy Policy. You may withdraw this consent at any time by deleting your account.

Not medical advice. The Services are for cosmetic, wellness and educational purposes only. They do not diagnose, treat, cure or prevent any disease or medical condition, and they are not a substitute for advice from a physician or other qualified professional. Do not disregard or delay seeking medical advice because of anything in the Services. If you have a medical concern, consult a physician. In an emergency, call 911.

Scan results. Scan results are generated by AI models and describe appearance only. Lighting, camera, angle and other conditions affect them. They may be inaccurate, and they may change from scan to scan.

Amber. Amber generates responses using artificial intelligence. Responses may be incomplete, inaccurate or out of date. Amber does not recommend specific products and does not give medical advice. Do not rely on Amber for any decision about your health.

Product and ingredient information. Ingredient information comes from third-party databases and brands' public materials. It may be incomplete or out of date. Always read a product's label and instructions before use. Information about ingredients that dermatologists generally recommend for particular skin concerns is general information. It is not tailored to you, and it is not a recommendation to use any product. Magic Mirror does not recommend specific products. Ratings of product effectiveness reflect users' own reports and do not establish that a product works.

Changes to the Services. We may change, suspend or discontinue any part of the Services at any time.

3. SkinCheck and Experts

Sharing a report. SkinCheck lets you share a report with an Expert you choose. You decide whether to share and with whom. You may revoke an Expert's access at any time.

Experts are independent. Experts are not employees or agents of Magic Mirror. We do not verify every Expert's credentials, and we do not supervise, endorse or take responsibility for any Expert's advice, services, products or fees. Any relationship between you and an Expert, including any payment, is solely between you and that Expert.

Product links. An Expert may include links to products in a report. The Expert, and Magic Mirror, may receive a commission if you buy through a link. Purchases are made with the retailer, under the retailer's terms.

4. Your content

Ownership. You own the photos, text and other content you submit ("Your Content").

License to us. You grant Magic Mirror a non-exclusive, royalty-free, worldwide license to host, store, copy, process, analyze and display Your Content, and to create scan results, reports and videos from it, solely to provide and improve the Services for you and as described in our Privacy Policy. This license ends when you delete Your Content or your account, except for copies we must keep under law. We will not use your photos or videos in our marketing without your separate, specific permission.

Your responsibility. You represent that you have the rights needed to submit Your Content, and that you submit only photos of yourself.

ProofReel videos. At your request, we generate a ProofReel video from your scans, scan results and progress. You decide whether to save or share it. When you share a ProofReel video, you are responsible for how you share it and for what you say about it.

The Verified Label. ProofReel videos carry a "Verified by Magic Mirror" label or a similar statement (the "Verified Label"). The Verified Label means only that the account holder used the app during the period shown and that the scan results shown were generated by the Services. It does not mean that Magic Mirror verified which products you used, how or how often you used them, or any other fact you report. It does not mean that Magic Mirror endorses any product or any statement you make. You may not alter the Verified Label, remove it from the period it covers, or place it on other content.

Endorsements. If you post content about a product and you have a material connection to the brand, such as payment or free products, you must disclose that connection as required by law.

5. Acceptable use

You may not:

• submit photos of anyone other than yourself;
• use the Services if you are under 18 or outside the United States;
• create accounts by automated means, create fake accounts, or impersonate anyone;
• misrepresent scan results, alter ProofReel videos, or misuse the Verified Label;
• use the Services to make medical claims about any product;
• copy, scrape, reverse engineer or interfere with the Services, or attempt to access them by unauthorized means;
• use the Services, or any output from them, to build or train a competing product or AI model;
• violate any law or anyone's rights.

6. Our property and third-party services

Our property. The Services, including the software, scores, designs and content we provide, belong to Magic Mirror and its licensors. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. If you are an Expert, you may also use the SkinCheck Expert Portal to provide your professional services, subject to any additional terms that we provide to you. We reserve all rights not expressly granted.

Feedback. If you send us suggestions, we may use them without obligation to you.

Third-party services. The Services rely on, and may link to, services operated by others. Those services are governed by their own terms. We are not responsible for them.

Google Play. If you obtained the app from Google Play, these Terms are between you and Magic Mirror only, not Google. Google has no obligation to provide maintenance or support for the app.

Apple App Store. If you obtained the app from the Apple App Store, the following terms also apply:

1. Parties. These Terms are between you and Magic Mirror only, not Apple Inc. ("Apple"). Magic Mirror, not Apple, is solely responsible for the app and its content.
2. Scope of license. Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. Magic Mirror is solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support for the app.
4. Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Magic Mirror's responsibility, to the extent not disclaimed in these Terms.
5. Product claims. Magic Mirror, not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including (a) product liability claims; (b) any claim that the app fails to conform to an applicable legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws.
6. Intellectual property claims. If a third party claims that the app, or your possession or use of it, infringes that party's intellectual property rights, Magic Mirror, not Apple, is solely responsible for the investigation, defense, settlement and discharge of the claim.
7. Legal compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third-party terms. You must comply with applicable third-party terms when using the app, such as your wireless data service agreement.
9. Contact. Direct any questions, complaints or claims about the app to Magic Mirror at the address in Section 13.
10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

7. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Sections 4, 6, 8, 9, 10 and 12 survive termination, except that the license you grant in Section 4 ends as stated there.

8. Disclaimers, limitation of liability and indemnity

Disclaimers. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, MAGIC MIRROR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCAN RESULTS, AMBER'S RESPONSES, PRODUCT INFORMATION OR EXPERT CONTENT ARE ACCURATE OR COMPLETE, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, MAGIC MIRROR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS. MAGIC MIRROR'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Indemnity. You will indemnify and hold harmless Magic Mirror and its officers, directors, employees and agents from any claim, loss or expense, including reasonable attorneys' fees, arising from Your Content, your use of the Services, or your breach of these Terms or of law.

9. Arbitration and class-action waiver

Informal resolution first. Before starting arbitration, you and Magic Mirror will try to resolve any dispute informally. The party raising the dispute must send written notice describing it to the other party (for you, to compliance@projectmagicmirror.com). If the dispute is not resolved within 60 days of the notice, either party may start arbitration.

Binding arbitration. Any dispute, claim or controversy arising from or relating to these Terms or the Services will be resolved by final and binding individual arbitration, except as stated below. The Federal Arbitration Act governs this Section. The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules. The arbitration will take place in the county where you live or by video conference, unless the parties agree otherwise. The arbitrator decides all issues, including the scope and enforceability of this Section. Fees are allocated under the AAA's rules.

Exceptions. Either party may bring an individual claim in small claims court, if it qualifies. Either party may seek injunctive relief in court to protect its intellectual property.

Class-action waiver. You and Magic Mirror may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. If this waiver is found unenforceable as to a claim, that claim will proceed in court, not in arbitration.

Jury trial waiver. You and Magic Mirror waive any right to a jury trial.

Opt-out. You may opt out of this Section by emailing compliance@projectmagicmirror.com within 30 days after you first accept these Terms. Your email must include your name, the email address of your account and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Severability. If any part of this Section is found unenforceable, the rest remains in effect, except as stated in the class-action waiver.

10. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act as to Section 9. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in New York County, New York, and you and Magic Mirror consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms. We will post the updated Terms and change the effective date. If a change is material, we will notify you in the app or by email before it takes effect. If you continue to use the Services after a change takes effect, you accept the updated Terms. Changes to Section 9 do not apply to disputes of which we had notice before the change.

12. General

These Terms, with the Privacy Policy, are the entire agreement between you and Magic Mirror about the Services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
